By accessing or using ClassTempo ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including instructors, students, and visitors.

2. Description of Service

ClassTempo is a real-time interactive classroom presentation platform that enables instructors to create engaging presentations with polls, quizzes, discussions, and other interactive activities. Students can join sessions using room codes and participate in real-time.

3. User Accounts

3.1 Instructor Accounts

Instructors must authenticate using Google Sign-In. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.2 Student Access

Students join sessions using room codes provided by instructors. Students must provide a display name when joining. Students are expected to participate appropriately and follow their instructor's guidelines.

4. Acceptable Use

You agree not to use the Service to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity or falsely state your affiliation with a person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
• Use the Service for any illegal or unauthorized purpose
• Collect or store personal data about other users without their consent
• Upload content that infringes on intellectual property rights of others

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of any content you upload to ClassTempo, including presentations, activities, and materials. By uploading content, you grant us a limited license to store, display, and transmit that content as necessary to provide the Service.

5.2 Our Content

The Service and its original content (excluding user-provided content), features, and functionality are owned by ClassTempo and are protected by copyright, trademark, and other intellectual property laws.

5.3 Student Responses

Student responses submitted during sessions are owned by the respective students, with instructors granted access for educational and assessment purposes as part of the classroom experience.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

7. Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available at all times. We may modify, suspend, or discontinue the Service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLASSPULSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless ClassTempo and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. Instructors may delete their accounts and associated data at any time.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
